Terms of Use

1. Who you’re dealing with

“FitSend,” “we,” and “us” means Ignite On Interactive, Inc., based in New Jersey, United States, which operates the FitSend app and fitsend.app. You can always reach us at support@fitsend.app.

2. What FitSend is, and what it depends on

FitSend copies supported health and fitness data you authorize from Google Health into the Apple Health app on your iPhone, then shows summaries and trends computed on your device. The sync is one-way, from Google Health to the Health app.

FitSend sits downstream of systems we don’t control. Source apps must make records available in Google Health, Google’s API must serve them, and iOS decides when background work may run. We build for reliability within those realities, but we can’t promise data will always be available, instant, or complete. Supported categories can change when Google or Apple change their platforms.

3. FitSend is not medical care

FitSend moves and displays wellness information. It is not a medical device and provides no diagnosis, treatment, alerts, or medical advice. Never rely on FitSend for health decisions or emergencies. Talk to a qualified professional, and if you think something is urgent, treat it as urgent.

4. Your account

• Your FitSend account is created when you connect a Google account. Connect only a Google account that is yours to use.
• You must be at least 13 years old (or the age of digital consent where you live). If you’re under 18, use FitSend only with a parent or guardian’s permission.
• Keep your device and Google account secure: they are the keys to your data.
• You can disconnect Google or delete your account at any time, in the app. How deletion works.

5. Free and PRO

The Free tier includes on-demand manual sync of your recent history, on-device insights, and every privacy and safety control. PRO adds automatic background sync and full-history import. Feature boundaries are shown in the app; monthly and annual PRO include identical features.

6. Subscriptions and billing

• PRO is an auto-renewing subscription billed by Apple through your App Store account, at the price shown in the App Store before you confirm.
• It renews automatically unless you cancel at least 24 hours before the end of the current period. Cancel any time in your device’s subscription settings (Settings → your name → Subscriptions).
• Refunds are handled by Apple under Apple’s policies, at reportaproblem.apple.com.
• Deleting your FitSend account does not cancel the Apple subscription; the app reminds you and links to Manage Subscriptions before deletion.
• We never receive your payment details, and your plan never changes how your data is treated.

7. Your data stays yours

You own your health data. You give us permission to process it solely to provide the sync and features you asked for, as described in our privacy policy, which is part of these terms. We claim no other rights in it.

8. Fair use

Please don’t:

• use FitSend for anything unlawful, or to process data belonging to someone who hasn’t authorized it;
• probe, overload, or interfere with the service, or bypass its security or rate limits;
• resell FitSend or misrepresent it as your own or as medical software;
• reverse engineer the service except where the law says we can’t stop you.

9. Our software

FitSend’s app, service, design, and branding belong to us and our licensors. We give you a personal, non-transferable license to use the app on Apple devices you own or control, as allowed by the App Store rules. This license is for using FitSend, not for copying or redistributing it.

10. Changes to the service

We improve FitSend continuously and occasionally must change or retire features, including when Apple or Google change what is possible. If a change materially reduces what a paid subscription includes, we’ll tell you in the app, and you can cancel before your next renewal.

11. Ending the relationship

You can leave any time by deleting your account in the app. We can suspend or end accounts that break these terms, abuse the service, or create legal or security risk, and where reasonable we’ll say why. Sections that by their nature should survive (like 7, 12, and 13) survive.

12. Honest disclaimers

FitSend is provided “as is.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that sync will be uninterrupted or error-free, that source data from Google or Fitbit is accurate, or that every record can be represented in the Health app. Where a faithful copy isn’t possible, FitSend reports the limitation rather than inventing data. That honesty is a feature, not a defect.

13. Limits on liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or goodwill. Our total liability for all claims relating to FitSend is capped at the greater of what you paid us in the twelve months before the claim or US $50. Some jurisdictions don’t allow certain limits, so parts of this section may not apply to you.

14. Terms Apple asks us to include

Because FitSend is distributed through the App Store:

• This agreement is between you and us, not Apple. Apple has no obligation to provide maintenance or support for FitSend and is not responsible for it.
• In case of FitSend’s failure to conform to a warranty, Apple may refund your purchase price; beyond that, Apple has no warranty obligation for FitSend.
• Claims about the app — product liability, legal compliance, consumer protection, and intellectual property claims — are our responsibility to address, not Apple’s.
• You confirm you are not in a country under a U.S. government embargo and not on any U.S. prohibited or restricted parties list.
• You must comply with applicable third-party terms (for example, Google’s terms for your Google account).
• Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.

15. Governing law

These terms are governed by the laws of the State of New Jersey and applicable United States federal law, without regard to conflict of law rules. State and federal courts located in New Jersey have exclusive jurisdiction, and you and we each consent to it — except where your local law grants you non-waivable rights or venue.

16. Changes to these terms

When we update these terms, the new version appears here with a new date. For material changes we’ll notify you in the app before they take effect. Continuing to use FitSend after that means you accept the update.
